I know that you need 2 licences to fish with more than 2 rods, but where does the law stand on actually fishing with 2 rods with a marker float out on a third?

I think the answer is in your question if you read it over.

Are you 'fishing' baited/hook on your marker rod!!!!!!!!!!!!!

Course not thats my point. If a rod is only being used as a means to provide a marker, are you actually fishing with it in the eyes of the EA?

Hmmmmmmmmmm

The maximum number of rods that you can fish with varies according to the type of water and fishing. This only applies to rods actually in use - you can have as many as you wish set up.
